COMMENTARY: This bizarre case, which was both sensational and horrifying, was difficult from a defense standpoint. The Philadelphia jury hearing the case, no doubt experienced both compassion for the plaintiff and anger at the callousness of his attackers. The case was especially sympathetic in that the young plaintiff, currently 22 years old, has dealt with physical and emotional disabilities since childhood. He spent eleven years in special education classes, but was finally mainstreamed in high school. This incident, which seems to have pushed him over the edge of a psychological abyss, occurred the week before his senior prom. He thereafter required in-patient care. The defendant did not dispute that the incident occurred, although it contended that there were some discrepancies in the plaintiff's version of events. Rather, the defense maintained that it had no knowledge of the plaintiff's abuse and was not responsible for the actions of the misguided perpetrators. The plaintiff's chances for a successful verdict were linked to establishment that the incident resulted from a lack of supervision on the part of the defendant. The assailants were all males in their late teens to early 20s. They were, essentially, judgment proof and were not defendants in the case. Plaintiff's counsel may also have been concerned that if the individuals had been named as defendants, it may have caused a diversion of attention from the main allegations of negligent supervision. The testimony of the plaintiff was at direct odds with that of the defendant's store managers. The plaintiff claimed that the managers were well aware of his mistreatment and had even stood by and witnessed the abuse. The defendant's witnesses denied any knowledge that the plaintiff was anything but well-liked by his co-workers. To support its position, plaintiff's counsel stressed that even after this totally unacceptable assault upon the plaintiff, the individuals involved were not terminated nor disciplined in any way by the defendant. They were charged criminally and pled guilty to reduced assault charges. By the time of trial, the assailants had all left the defendant's employ for reasons other than the attack upon the plaintiff and none of them testified. Defense counsel strove to present the defendant in the most favorable light, arguing that it attempted to assist this young man with physical and emotional difficulties by giving him a job and had no indication that he would be attacked at work. The jury apparently accepted the defense position that it was not responsible for the mistreatment encountered by the plaintiff.
